2. Quali dati trattiamo

4. Obbligo di fornire i dati
Inviarci i dati è facoltativo.

| IONOS SE | Posta elettronica aziendale | Unione europea (Germania) |
Puoi chiederci informazioni su queste garanzie scrivendo a studio@marsc.it.
8. I tuoi diritti
- sapere se trattiamo tuoi dati e riceverne copia (accesso, art. 15);
- correggerli o aggiornarli (rettifica, art. 16);

This policy explains how MARSC Holding Group S.r.l. processes the personal data of visitors to www.marsc.it and of people who write to us using the contact and trade request forms. The Italian version prevails in case of discrepancies.
1. Data controller
MARSC Holding Group S.r.l.
Registered office: Via La Farina 47, 50132 Florence (FI), Italy
Operational office: Via Lorenzo di Credi 20/A, 50136 Florence (FI), Italy
VAT IT07163310480
Email: studio@marsc.it · Phone: +39 055 80 24106
The controller has not appointed a Data Protection Officer, as it is not required to. For any privacy question, write to studio@marsc.it.
2. What data we process
- Browsing data. Like any website, the server hosting this site automatically logs some technical data about visits (IP address, browser and device type, date and time, page requested). It is used only to run the site and protect it from abuse and attacks; we do not use it to identify you.
- Data sent through the forms. Full name, company name, email, phone, VAT number, country and city, type of business, brands of interest and the text of your message. Please do not include special categories of data (for example health data) or other people's data in your message.
- Data sent by email or phone. If you contact us directly, we process the data you give us in order to reply.
The site does not use analytics, advertising or profiling tools. For details of the technical tools used, see the cookie policy.
3. Why we process data and on what legal basis
| Purpose | Legal basis |
|---|---|
| Replying to your requests, sending catalogues, price lists and terms, assessing and starting a business relationship | Pre-contractual steps taken at your request (Art. 6(1)(b) GDPR) |
| Managing the business relationship if one begins (orders, invoicing, support) | Performance of a contract (Art. 6(1)(b)) and legal obligations such as tax and accounting (Art. 6(1)(c)) |
| Keeping the site secure and blocking spam and fraudulent submissions | Legitimate interest of the controller in protecting the site and its systems (Art. 6(1)(f)) |
| Defending our rights in case of disputes | Legitimate interest of the controller (Art. 6(1)(f)) |
We do not use your data for newsletters or promotional messages, we do not sell it, and we do not pass it to third parties for their own marketing. We do not make decisions based solely on automated processing.
4. Is providing data mandatory?
Sending us your data is optional. However, the fields in the forms are needed for us to reply: without them we cannot handle your request.
5. Who can see the data
Data is processed by authorised and trained staff of MARSC Holding Group S.r.l. at its Florence office. We do not share requests received through the site with other group companies or foreign partners.
To run the site we use providers that process data on our behalf as processors (Art. 28 GDPR):
| Provider | Service | Where data is processed |
|---|---|---|
| Cloudflare, Inc. | Website hosting, content delivery and attack protection | United States and global network |
| Web3Forms (Web3Creative) | Receiving form submissions and forwarding them to our mailbox | India and its sub-processors (EU, United States) |
| IONOS SE | Business email | European Union (Germany) |
Where necessary, data may also be disclosed to the controller's advisers (for example accountant or lawyer), who are bound by confidentiality, and to authorities when required by law. Data is never published.
6. Transfers outside the European Union
Some of the providers above also process data outside the EU. Transfers rely on the safeguards provided by the GDPR: for Cloudflare, Inc., certification under the EU-U.S. Data Privacy Framework (European Commission adequacy decision of 10 July 2023) and Standard Contractual Clauses; for Web3Forms, the Standard Contractual Clauses approved by the European Commission (Decision 2021/914). You can ask us about these safeguards at studio@marsc.it.
7. How long we keep data
- Requests that do not lead to a business relationship: 24 months from the last contact, then deleted.
- If a business relationship begins: for its whole duration and, after it ends, for 10 years to meet civil-law and tax obligations (Art. 2220 of the Italian Civil Code).
- Browsing data: for as long as strictly needed for security, according to the hosting provider's settings.
The form service provider keeps a technical copy of submissions in its systems for up to three years, as set out in its data processing agreement.
8. Your rights
At any time you can ask the controller to:
- confirm whether we process your data and give you a copy (access, Art. 15);
- correct or update it (rectification, Art. 16);
- delete it (Art. 17);
- restrict its processing (Art. 18);
- receive it in a machine-readable format or have it sent to another controller (portability, Art. 20);
- object to processing based on legitimate interest (Art. 21).
To exercise these rights, write to studio@marsc.it. We reply without delay and in any case within one month. If you believe the processing breaches the GDPR, you can lodge a complaint with the Italian Data Protection Authority (www.garanteprivacy.it) or with the authority of the country where you live or work.
9. Minors
The site and our services are aimed at businesses and professionals. We do not knowingly collect data from people under 18.
10. Links to other sites
The site contains a plain link to our LinkedIn page, with no embedded content or buttons. If you follow it, LinkedIn processes your data under its own privacy policy.
11. Changes
We may update this policy, for example if the site's services or the law change. The current version is always published on this page, with the date of the last update.
